Il corso si propone di illustrare, per il loro particolare interesse da un punto di vista comparatistico, i cd. sistemi misti tra common law e civil law, con particolare riguardo alla forma di stato e di governo, alle fonti del diritto ed alla giurisprudenza costituzionale.
The course aims at focusing on mixed legal systems due to their importance and interest from a comparative point of view. It will address, in particular, their peculariaties concerning the system of governement, the sources of law and the judicial review of legislation.
Le conoscenze saranno verificate attraverso una prova finale orale. Tuttavia al termine di ciascun modulo i docenti consentiranno agli studenti frequentanti la possibilità di sostenere una prova scritta facoltativa.
Knowldge will be assessed through an oral exam.
Al termine del corso gli studenti dovranno dimostrare di aver acquisito un'adeguata conoscenza delle peculiarità dei sistemi misti e la conoscenza delle differenze e delle analogie con i sistemi di civil law e common law, soprattutto per quanto attiene al sistema delle fonti, alla tutela dei diritti umani e alla giurisprudenza costituzionale
At the end of the course students should get an adequate knowledge of the peculiarities of the mixed jurisdictions, in particular their differences and analogies with the civil law and commo law systems concerning the sources of law, the protection of fundamental rights and judicial review of legislation
L'esame sarà un esame orale che testerà la conoscenza degli argomenti svolti durante il corso e del materiale fornito agli studenti. Gli studenti potranno sostenere un esame scritto, su base volontaria, a alla fine del corso
The exam will be an oral exam that will test the knowledge of the topics covered during the course and of the material provided to the students. Students will be able to take a written exam, on a voluntary basis, at the end of the course
The final exam will be an oral exam. Its purpose will be to verify the adequate knowledge of the topics which have been addressed during the classes and the materials that will be provided to the students. At mid-course students will have the opportunity to take an intermediate exam in order to test the knowledge of the issues which have been addressed in the first half of the course
Dato il carattere seminariale delle lezioni in cui saranno discussi ed esaminati dei materiali (normativi, giuripsrudenziali o dottrinali) gli studenti saranno stimolati al dialogo ed alla riflessione comune.
As the classes will mostly be seminars in which the seminar materials (cases, scholarly works, legislative materials) will be thorougly discussed, students should engage in a dialogue with the teacher and their colleagues. The teacher will stimulate a debate on the materials.
Propedeuticità
Per sostenere l’esame:
per gli studenti iscritti al corso di laurea in Dilpa è prevista la propedeuticità di Diritto comparato;
per tutti gli altri è fortemente consigliato il superamento di un esame di una materia comparatistica (per la LMG Sistemi giuridici comparati).
Si consiglia vivamente la conoscenza (almeno a livello intermedio) della lingua inglese
Propaedeuticity
To take the exam:
for students enrolled in the degree course in Dilpa is provided for the propaedeuticity of Comparative Law;
for all the others, it is strongly recommended to have passed an exam the field of comparative law (for the LMG Comparative legal systems).
Knowledge of the English language (at least at intermediate level) is highly recommended
Il corso si propone di illustrare le peculiarità dei cd. sistemi misti tra common law e civil law, con particolare riguardo alla forma di stato e di governo, alle fonti del diritto e di approfondire i caratteri della giustizia costituzionale in questi ordinamenti. Tra gli ordinamenti che saranno presi in considerazione nel corso di lezioni vi saranno Canada, il Sud Africa ed altre esperienze in cui la giustizia costituzionale presenta profili di grande interesse e le pronunce del giudice costituzionale offrono rilevanti spunti di riflessione, sia per quanto riguarda ai profili sostanziali che per quanto attiene alle tecniche di comparazione, al di dialogo con altre corti, alle fonti utilizzate ed all’interpretazione giuridica.
Il corso avrà un carattere seminariale e durante le lezioni saranno forniti dai docenti materiali giurisprudenziali, normativi e dottrinali che risulteranno utili non solo per illustrare gli argomenti affrontati ma anche ai fini di una discussione.
Gli studenti potranno reperire i materiali iscrivendosi al corso sulla piattaforma di e-learning.
Gli studenti potranno dunque preparare l'esame sul materiale fornito dai docenti e discusso durante le lezioni.
The course aims at illustrating the peculiarities of the so-called mixed systems between common law and civil law, with particular regard to the legal system, the sources of law and the features of constitutional justice. Among the legal systems that will be taken into consideration during the lectures there will be Canada, South Africa and other jurisdictions where constitutional justice and the rulings of the constitutional judge offer interesting research topics both concerning constitutional law issues and the the techniques of comparison, the dialogue with other courts, the sources of law and their interpretation.
The course will have a seminar character and during the lessons the teachers will provide cases and scholarly works that will be useful not only to illustrate the topics addressed but also for stimulating discussion.
Students will be able to find the materials by registering for the course on the e-learning platform.
Students will therefore be able to study the material provided by the Professors and discussed with them during the lessons.

Verifica dell’apprendimento
L’esame finale si svolgerà in forma orale con possibilità di svolgimento di una verifiche scritte al termine di ciascuno modulo, comunque facoltative per gli studenti.
