L’insegnamento mira ad approfondire, con un approccio comparatistico, le principali esperienze giuridiche non riconducibili alla tradizione giuridica occidentale. Verranno in particolare esaminate le esperienze in relazione alle quali l’ordinamento italiano entra più frequentemente in contatto in conseguenza dei flussi migratori in entrata.
Nell’analisi delle esperienze, alla didattica classica si assoceranno lezioni svolte in forma seminariale, dirette ad approfondire singole tematiche che risultino di particolare rilievo, anche per le possibili ricadute sull’ordinamento italiano.
The aim of the course is to deepen, through a comparative approach, the main legal experiences that cannot be traced back to the Western legal tradition. In particular, the experiences in relation to which the Italian legal system comes into contact most frequently as a result of incoming migration flows will be examined.
In the analysis of the experiences, the classical didactics will be combined with lectures held in the form of seminars, aimed at investigating individual issues that are particularly relevant, including the possible effects on the Italian legal system.
Propedeuticità
Per sostenere l’esame:
per gli studenti iscritti al corso di laurea in Dilpa è prevista la propedeuticità di Diritto comparato;
per tutti gli altri è fortemente consigliato il superamento di un esame di una materia comparatistica (per la LMG Sistemi giuridici comparati).
Propaedeuticity
To take the exam:
for students enrolled in the degree course in Dilpa is provided for the propaedeuticity of Comparative Law;
for all the others, it is strongly recommended to pass an exam on a comparative subject (for the LMG Comparative legal systems).

– H.P. GLENN, Tradizioni giuridiche nel mondo. La sostenibilità della differenza, Bologna, il Mulino, 2010 (limitatamente ai capitoli III (tradizione ctonia), IV (tradizione talmudica), VI (tradizione islamica), VIII (tradizione indù), IX (tradizione confuciana), X (riconciliare le tradizioni giuridiche), con esclusione delle note);
– Dispensa sul diritto cinese reperibile nelle pagine relative al corso inserite sulla piattaforma e-learning del Dipartimento (http://polo4.elearning.unipi.it/).

Verifica dell’apprendimento
L’esame finale si svolgerà in forma orale. Non sono previste prove intermedie. Lo svolgimento di eventuali verifiche scritte, comunque facoltative per gli studenti, verrà tempestivamente comunicato.
Verification of learning
The final exam will take place in oral form. There will be no intermediate tests. Any written checks, which are optional for the students, will be promptly communicated.
