Learning outcomes

The advent of the computer technologies and their applications raised problems concerning legal rules.
The objective of the course is to analyse these problems, considering both the specific legal rules for the digital age and the possibility of employment of general law.
Precisely, the course proposes to examine some important legal themes of the digital age, with particular reference to the more typical ones of business context, such as Electronic Commerce, Personal Data and their treatment and Internet Torts.

Syllabus

- Electronic Commerce. Conclusion, validity, form and proof of the Cyberspace Transactions by e-mail and point and click: application of the general rules, derogations and special rules. The European Directive about Electronic Commerce and d.lgs. n°70/2003. Computer service Contracts.
- Consumer Protection and the rules of information in net: general, commercial and not solicited advertising information (“spamming”). Advertising information in the regulated professions.
- Treatment of Personal Data (d.lgs.n°196/2003). Notion and persons of treatment. Briefing and consent. Treatment made by electronic instruments. Safety of data: the programmatic document about security. Civil, administrative and penal remedies. Treatment in outsourcing of personal data.
- Digital Signature, Electronic Signature and Computer Document: form, validity and proof. The Certified E-mail. Computer transmission of documents. The figure of “certificatori”.
- Domains Names. Business Domain Names. The rules of the Registration Authority.
- Internet Torts and Providers Liability.
Software Protection. Free Software and Property Software. Copyright in the Internet Age.
- Internet Payments and Electronic Cash.
