Conoscenze

Il corso presuppone che gli studenti NON abbiano alcuna nozione di diritto e per questo motivo per tutta la prima parte del corso verranno introdotti i concetti fondamentali di natura giuridica con linguaggio e terminologia che tenga conto di questo presupposto.

Al termine del corso, auspicabilmente, lo studente avrà acquisito la conoscenza dei principali istituti giuridici che regolano la tutela e la valorizzazione dei Beni Culturali in Italia. Avrà inoltre acquisito la capacità di orientarsi nell'ambito della legge fondamentale che disciplina la materia ovvero il Codice dei Beni Culturali e del Paesaggio approvato con il D.Lgs. 22 gennaio 2004 n. 42.

L'apprendimento di queste nozioni si rivela molto utile e sarà "spendibile" soprattutto per coloro che al termine degli studi saranno chiamati a partecipare a concorsi pubblici, affronteranno la carriera accademica, svolgeranno attività di lavoro autonomo oppure comunque si troveranno ad avere rapporti con il Ministero della Cultura o, più in generale, con la Pubblica Amministrazione. Queste nozioni sono altresì la base per comprende al meglio il contesto giuridico degli argomenti oggetto dei corsi di laurea magistrale.

Knowledge

The course assumes that students have no notion of right and for this reason throughout the first part of the course will be introduced the fundamental legal concepts with language and terminology that takes into account this assumption.

The student who successfully completes the course will have the ability to :

- will be able to identify the main legal institutions that govern the protection and enhancement of the Italian cultural heritage;

- can deal with a sufficient knowledge base legal schools of post-graduate and major competitions for access to the lists of public administration that is dedicated to the protection and enhancement of cultural heritage;

- will have acquired a number of basic legal knowledge to carry out the professions related to the protection and preservation of cultural heritage within the limits and the rules laid down in the Code of Legislative Decree no. 42/2004.

The learning of these notions is very useful and will be "spendable" especially for those who at the end of the studies will be called to participate in public competitions, will face an academic career, carry out self-employment activities or in any case find themselves having relations with the Ministry of Culture or, more generally, with the Public Administration. These notions are also the basis for the best understanding of the legal context of the topics covered by the master's degree courses.

Modalità di verifica delle conoscenze

L'accertamento delle conoscenze sarà svolto nel corso delle lezioni oltre che al termine di esse con la prova d'esame orale.

Lo studente sarà valutato sulla sua capacità di discutere i contenuti del corso principale utilizzando la terminologia appropriata. Durante la prova orale lo studente deve essere in grado di dimostrare la sua conoscenza del materiale presentato durante il corso ed essere in grado di orientarsi sugli argomenti trattati a lezione e studiati sui testi d’esame. Sarà valutata la capacità dello studente di spiegare correttamente gli argomenti presentati durante il corso utilizzando i file di Word e le slide di PPT.

Assessment criteria of knowledge

Assessment of knowledge will be carried out during the lessons as well as at the end of them with the final oral exam.

The student will be assessed on his ability to discuss the contents of the main course using the appropriate terminology. During the oral exam the student must be able to demonstrate his knowledge of the material presented during the course and be able to orient himself on the topics covered in the lesson and studied on the exam texts. The student's ability to correctly explain the topics presented during the course will be assessed using Word files and PPT slides.

Capacità

Al termine del corso, lo studente sarà in grado di individuare le norme del Codice che disciplinano ogni questione correlata alla tutela e alla valorizzazione dei Beni Culturali. Una capacità essenziale che completa lo studio delle Scienze dei Beni Culturali.

Skills

At the end of the course, the student will be able to identify the rules of the Code governing all matters related to the protection and enhancement of Cultural Heritage. An essential ability to complete the study of Cultural Heritage Sciences.

Modalità di verifica delle capacità

Le capacità acquisite saranno misurate, al termine del corso di studi, nel momento in cui l'ex studente dovrà rapportarsi con il mondo del lavoro.

Le nozioni apprese durante il corso si riveleranno una buona base di partenza per affrontare tirocini, stage formativi, la frequenza delle Scuole di Specializzazione su tutto il territorio nazionale.

Assessment criteria of skills

The acquired skills will be measured at the end of the course, when the former student will have to deal with the world of work.

The lessons learned during the course will prove to be a good starting point for dealing with internships, training sessions, the attendance of specialized schools throughout the country.

Lo studente potrà acquisire e/o sviluppare una peculiare sensibilità alle nozioni di diritto essenziali per comprendere e soprattutto applicare le norme giuridiche che regolano i settori della tutela e della valorizzazione dei Beni Culturali nell'ordinamento giuridico italiano.

Behaviors

The student will acquire and / or develop a peculiar sensibility to the notions of fundamental right to understand and above all apply the legal rules governing the fields of protection and enhancement of Cultural Heritage in the Italian legal system.

Prerequisiti (conoscenze iniziali)

Lo studente deve conoscere la storia d'Italia e d'Europa oggetto dei programmi della scuola secondaria di secondo grado.

E' altresì importante la conoscenza dei principi della Carta Costituzionale e delle regole che in essa disciplinano l'ordinamento della Repubblica (Parlamento, Governo, Magistratura, Pubblica Amministrazione, Regioni ed Enti locali).

Prerequisites

The student must know the history of Italy and Europe covered by Secondary Secondary School programs. It is also important to know the principles of the Constitutional Charter and the rules that govern the order of the Republic (Parliament, Government, Judiciary, Public Administration, Local and Regional Authorities).

Indicazioni metodologiche

Il docente svolgerà esclusivamente lezioni frontali con ausilio di materiale che in parte sarà scaricabile dalla piattaforma Moodle Unipi.

Tali supporti saranno messi a disposizione di volta in volta prima di ogni lezione.

Per avere un'idea del prossimo corso e degli argomenti che saranno affrontati, si consiglia di esaminare i file già inseriti su Moodle per il corso dell'A.A. 2021/2022.

L'interazione tra studente e docente avverrà nei ricevimenti e con l' uso della posta elettronica. Oltre che a lezione.

Non sono previste prove intermedie.

Le lezioni saranno tenute esclusivamente in italiano.

Teaching methods

The teacher will exclusively carry out lectures with the help of material that will be partly downloadable from the Moodle Unipi platform.

Such media will be made available from time to time before each lesson.

To get an idea of the next course and the topics that will be addressed, it is advisable to examine the files already entered on Moodle for the course of the A.Y. 2021/2022.

The interaction between student and teacher will take place at receptions and with the use of electronic mail. As well as in class.

There are no intermediate tests.

Lessons will be held exclusively in Italian.

Programma (contenuti dell'insegnamento)

L’obiettivo del corso è quello di permettere allo studente di orientarsi all’interno del Codice, dimostrando la conoscenza dei principi contenuti nella normativa e degli istituti giuridici ivi previsti e disciplinati.

Durante il corso saranno quindi impartite le nozioni fondamentali di diritto necessarie a comprendere al meglio l’applicazione delle norme del Codice.

Nel dettaglio, il corso di soffermerà sui seguenti temi:

- la struttura del Codice;

- le fonti che hanno preceduto il Codice;

- le nozioni di Testo Unico e di Codice;

- le fonti del diritto della tutela e della valorizzazione,  i soggetti coinvolti e i loro rapporti; ci si soffermerà, in questo ambito, ad evidenziare la ripartizione delle competenze legislative e regolamentari tra Stato, Regioni ed enti locali in base alle riserve e ai principi fissati dalla Carta Costituzionale;

- saranno quindi affrontati i principi contenuti nella Parte Prima del Codice (Disposizioni generali).

Della Parte Seconda del Codice (Beni culturali), ci si soffermerà per prima cosa sulle categorie di beni culturali individuate dall’art. 10.

Saranno poi trattati temi fondamentali, quali:

- la “verifica” dell’interesse culturale e gli atti di disposizione dei beni pubblici;

- la “dichiarazione” di interesse culturale e la vendita dei beni privati;

- le misure di protezione dei beni culturali;

- le misure di conservazione;

- la circolazione in ambito nazione e internazionale dei beni culturali e delle cose di interesse culturale;

- i ritrovamenti e le scoperte;

- le espropriazioni di beni culturali e gli altri provvedimenti di natura latu sensu ablatoria previsti dal Codice;

- il concetto di fruizione dei beni culturali; il rapporto tra conservazione, fruizione e valorizzazione; uso e godimento generalizzato, speciale e individuale dei beni culturali;

- la valorizzazione dei beni culturali: nozione e finalità; le attività di valorizzazione e gli strumenti regolati dal Codice; la gestione delle attività di valorizzazione e il ruolo dei privati.

Syllabus

The aim of the course is to allow students of the Faculty of Humanities to orient the Code , demonstrating knowledge of the principles contained in the legislation and legal institutions therein and disciplined.

During the course will then be given the basics of law needed to better understand the application of the provisions of the Code.

In detail, of course linger on the following topics :

- the structure of the Code;

- the sources that preceded the Code;

- the concepts of Consolidated Law and Code;

- the sources of law for the protection and enhancement, the people involved and their relationships , we will focus , in this context , to highlight the division of legislative and regulatory competence between the state, regions and local authorities on the basis of reserves and with the principles established by the Constitution ;

- Will accordingly be addressed to the principles contained in Part I of the Code ( General Provisions).

The second part ( Cultural Heritage ) , we will focus first on the categories of cultural property set forth by Art . 10.

Will then be treated fundamental issues , such as:

- The "verification" of cultural and acts of disposal of public assets ;

- The "declaration " of cultural interest and the sale of private property ;

- Measures for the protection of cultural heritage;

- The conservation measures ;

- Circulation within the nation and international cultural heritage and things of cultural interest;

- The findings and discoveries;

- The expropriation of cultural and other action taken in broad sense ablatoria provided by the Code;

- The concept of the use of cultural heritage and the relationship between conservation, use and development, use and enjoyment general, special and individual cultural heritage;

- The promotion of cultural heritage: the concept and purpose; valorisation activities and instruments regulated by the Code, and the management of development and the role of private.

E' assolutamente necessario che lo studente si procuri un testo aggiornato del D.Lgs. 42/2004 (Codice dei Beni culturali e del Paesaggio) da consultare a lezione e che in sede di esame dovrà dimostrare di avere letto sapendone riconoscere principi e istituti.

Il testo verrà comunque fornito dal docente e inserito sulla piattaforma Moodle Unipi.

Giuliano Volpe "Un patrimonio italiano - Beni culturali, paesaggio e cittadini", UTET, 2016 per una efficace carrellata di esempi di valorizzazione "dal basso" del patrimonio culturale.

It is absolutely necessary that the student fetch an updated text of Legislative Decree no. 42/2004 (Code of Cultural Heritage and Landscape) to consult in class and in the examination will have to demonstrate that you have read knowing how to recognize principles and institutions.

The text will still be provided by the teacher and placed on the Moodle Unipi platform.

Modalità d'esame

L'esame è composto esclusivamente da una prova orale.

La prova consiste in un colloquio tra il candidato e il docente, o anche tra il candidato e altri collaboratori del docente titolare.

La durata media del colloquio è di circa venti minuti / mezz'ora.

La prova riguarda l'intero programma. Non sono previste prove intermedie.

La prova orale non è superata se il candidato non si esprime in modo chiaro, se non usa la terminologia corretta oppure se il candidato non dimostra di sapersi orientare nell'individuare i principi che regolano i casi e le questioni proposte dal docente.

Si invitano caldamente gli studenti candidati alle sessioni d’esame ad iscriversi nella lista nel termine assegnato. Una volta iscritti, nel caso di rinuncia a sostenere l’esame, i candidati sono invitati a cancellarsi dalla lista o ad avvisare il docente anche via mail con un congruo anticipo.

Assessment methods

Examination consists solely of an oral exam.

The test consists of an interview between the candidate and the teacher, or even between the candidate and other staff members of the teacher.

The average length of the interview is about twenty minutes / half an hour.

The test is about the entire program. No intermediate tests are provided.

The oral examination is not passed if the candidate does not express himself clearly, if he does not use the correct terminology or if the candidate does not prove to know how to orientate in determining the principles governing the cases and questions proposed by the teacher.

Exam candidates are strongly encouraged to enroll in the list within the assigned term. Once enrolled, in case of a waiver of the exam, candidates are invited to cancel the list or to notify the teacher by mail with a reasonable advance.

Il docente non effettua esami “fuori appello” e sul punto non è ammessa alcuna deroga.
