Obiettivo del corso è quello di illustrare i profili generali della garanzia delle libertà e dei diritti costituzionali e di approfondire, nella seconda parte del corso, un particolare profilo relativo alla tutela dei diritti fondamentali attraverso l'analisi e la discussione di casi giurisprudenziali e testi normativi.
The main purpose of the course it to illustrate and analise the general principles concerning the protection of human rights in the Italian constitutional system. The second part of the course will instead address some specific issues concerning the violation of human rights, through the analysis and discussion of the relevant regulation and constitutional cases.
La verifica delle conoscenze si accerta al termine del corso con un esame finale orale. Agli studenti sarà fornita la possibilità di sostenere una prova scritta intermedia facoltativa dopo la prima parte delle lezioni.
The knowledge of human rights law will be assessed through a final oral examination. The students will also have the possibility to take a written intermediate midterm exam.
Alla fine del corso lo studente dovrebbe aver acquisito una conoscenza dei principi e degli strumenti di garanzia che riguardano la tutela dei diritti fondametnali nel nostro ordinamento e avere la capacità di orientarsi nell'analisi e nella discussione della giurisprudenza costituzionale sul tema.
At the end of the course, the student should have reached an adequate knowledge of the general priniples and guarantees concerning the protection of fundamental rights and liberties in the Italian constitutional system. The student should also be able to analyse and discuss the Constitutional court's cases addressing the protection of human rights.
L'esame finale si svolgerà in forma orale e verificherà l'acquisizione delle abilità e delle conoscenze descritte nel campo precedente relativo alle capacità.
Students will take a final oral examination in order to verify the acquisition of the knowledge and skills described in the field "Skills" above.
Con lo studio della materia lo studente potrà acquisire conoscenze e sviluppare sensibilità relative alla tematica dei diritti umani. Potrà in particolare comprendere quali sono gli strumenti di tutela dei diritti e saperne fare applicazione anche in altri ambiti in cui è oggi vivo il dibattito sui diritti fondamentali.
Through the study of human rights law the student will develop the knowledge of the most important guarantees and judicial arguments concerning hte protection of human rights. He/she will also be able to analyse other important issues that have raised an heated debate on human rights in the last decades and to apply the arguments and the principles discussed during the course even to these fields.
Durante il corso saranno organizzate attività seminariali con docenti che hanno approfondito alcuni temi specifici nelle loro attività di ricerca recenti. Inoltre saranno discusse e analizzate le sentenze costituzionali al fine di illustrare quali sono gli argomenti e le tecniche di giudizio sviluppate dal giudice costituizonale.
During the couse the teacher will organise seminars with scholars who have made exstensive academic research on the issues discussed during the course. At the same time during the second half of the course, the teacher will discuss constitutional law cases in order to explain which are the most important legal arguments and tecniques used by constitutional courts in cases concerning the violation of human rights.
Allo studente è vivamente consigliato di aver sostenuto gli esami di Diritto Costituzionale I e II.
Students are highly recommended to take the exams of Constituional Law I and II before attending the course.
Obiettivo del corso è quello di illustrare i profili generali della disciplina e della garanzia delle libertà e dei diritti costituzionali e di approfondire una specifica tematica su cui si sono registrati negli ultimi anni rilevanti sviluppi giurisprudenziali e normativi.
In particolare, la prima parte del corso avrà ad oggetto i profili generali di tutela delle libertà e dei diritti fondamentali nel nostro ordinamento costituzionale e si soffermerà in modo particolare sul principio personalista, sul principio di eguaglianza e sulla relativa giurisprudenza costituzionale.
Il seguito delle lezioni avrà, invece, un carattere monografico e sarà dedicato all’approfondimento ed alla discussione di pronunce e testi normativi aventi ad oggetto la tutela dei diritti delle donne e la parità di genere. Si tenterà inoltre di inquadrare il dibattito italiano nella giurisprudenza della COrte EDU e di fornire anche uno sguardo comparatistico su altri ordinamenti che hanno affrontato simili questioni negli ultimi anni.
The purpose of the course is to provide a general overview and to discuss some recent relevent developments of human rights law. In particular the first part of the course will focus on the regulation of rights and fundamental liberties in the Italian constitution looking, in particular, at the protection of the person (the so callled "principio personalista", enshrined in art. 2 Cost), equal protection and the most important constitutional cases which have enforced those principles. The second part of the course will focus instead on a more specific issue of human rights law, in particular gender equality and protection of women rights. This topic will be discussed through the analysis of the relevant cases of the Italian Constitutional court. At the same time someì ECtHR and constitutional foreign cases that have addressed similar issues in the last decades will be taken into account.
Gli studenti frequentanti potranno preparare l'esame servendosi del materiale che sarà fornito dalla docente durante il corso delle lezioni attraverso la piattaforma di e-learning.
Gli studenti non frequentanti potranno invece preparare l'esame sul seguente libro di testo:
P. Caretti, G. Tarli Barbieri, I diritti fondamentali. Libertà e diritti sociali, Torino, Giappichelli, 2017 (quarta edizione). Di tale testo dovranno in particolare studiare i capitoli dall'I al VI (compreso).
Nota: Si raccomanda agli studenti di prestare attenzione all'edizione: si consiglia di studiare sull'edizione del 2017.
Students who will attend the classes may study the material that will be provided during the course through the e-learning platform.
Students who will not attend the classes may prepare the exam studying the following book:
P. Caretti, G. Tarli Barbieri, I diritti fondamentali. Libertà e diritti sociali, Torino, Giappichelli, 2017 (IV edition). In particular students should study the first six chapters.
I non frequentanti potranno preparare l'esame studiando il libro di testo. Si consiglia loro uno studio attento della giurisprudenza costituzionale illustrata nel testo e si raccomanda una costante lettura dei quotidiani per avere una conoscenza dei temi più dibattuti sul piano dei diritti umani.
The students who will not attend the course can prepare the exam studying the book suggested above. I recommend to focus closely on the constitutional law cases discussed in the the text and to read always italian and foreign newpapers in order to get an idea of which are most debated human rights issues at the moment.
La prova orale consiste in un colloquio tra il candidato e il docente, o anche tra il candidato e altri collaboratori del docente titolare. Dopo la prima parte delle lezioni gli studenti frequentanti potranno decidere disostenre una prova scritta intermedia facoltativa, così da ricevere una prima valutazione sugli argomenti fino ad allora svolti a lezione.
The final exam will be an oral exam. The student will be asked to answer some questions concerning the issues that have been discussed during the course (or that he has studied on the book). Students who will attend the course will have the opportunity to take an optional midterm exam. It will be a written exam on the issues that have been discussed during the first classes.
