Conoscenze

Al termine del corso lo studente potrà acquisire conoscenze rispetto alle fondamentali tecniche argomentative e di persuasione giudiziale, e più precisamente in merito alle cinque parti di cui constava la retorica antica: inventiodispositioelocutiomemoriapronuntiatio.

Sarà inoltre dato ampio spazio alla moderna eredità della retorica classica ed ai modelli argomentativi delle cd. "nuove retoriche".

Knowledge

The student who successfully completes the course will be able to demonstrate the knowledge of the basic techniques of argumentation and persuasion before a judge. More than anything, he/she will have to paying attention to the the five parts of the ancient rhetoric: inventio, dispositio, elocutio, memoriae pronuntiatio.

Special attention will be paid to the modern heritage of classical rhetoric and to the argumentative models of the "new rhetoric".

Modalità di verifica delle conoscenze

La verifica delle conoscenze si accerta al termine del corso con un esame finale, secondo le modalità indicate nello specifico campo.

Assessment criteria of knowledge

The knowledge is verified at the end of the course with a final exam, according to the indicated methods.

Capacità

Al termine del corso lo studente sarà in grado di argomentare/confutare una tesi giuridica alla luce di un modello per l'organizzazione del discorso persuasivo articolato in quattro parti principali: exordiumnarratioargumentatioperoratio.

Skills

At the end of the course the student will be able to argue / refute a legal thesis by the use of a fixed persuasion model, that is composed of four main parts: exordium, narratio, argumentatio and peroratio.

Modalità di verifica delle capacità

In sede di esame finale sarà valutata la capacità applicativa degli studenti delle nozioni apprese durante l’insegnamento.

Assessment criteria of skills

During the final exam the student must be able to demonstrate his/her ability to apply the concepts learned during the course.

Comportamenti

Lo studente potrà acquisire e/o sviluppare la propria tecnica argomentativa in relazione a problematiche giuridiche di varia natura.

Behaviors

The student can acquire and/or develop his own argumentative technique in relation to different legal topics.

Modalità di verifica dei comportamenti

Durante i corsi potranno essere organizzate attività seminariali, al termine delle quali verrà richiesta una breve relazione scritta/orale concernente gli argomenti trattati.

Assessment criteria of behaviors

During the course the student must be able to demonstrate his/her ability to write and/or to speach about the contents of the organized seminar activities.

Prerequisiti (conoscenze iniziali)

Il corso è consigliabile per studenti che abbiano già acquisito una basilare formazione giuridica nelle discipline privatistiche e pubblicistiche.

Prerequisites

The course is recommended for students who have already acquired a basic training in the private and public law.

La dispositio.

L'elocutio. In particolare: sinonimi, tropi e figure.

La memoria e la pronuntiatio.

Oratory and rhetoric in Rome.

Cicero and the oratory activity before the permanent tribunals.

Quintilian's rhetorical pedagogy.

The modern heritage of classical rhetoric.

 Not-attending students must study the same pages of the book indicated under bibliography. There are no differences in respect of the assessement methods used for non-attending students.  

Modalità d'esame

L'esame prevede una prova orale. La prova orale consiste in un colloquio tra il candidato e il titolare del corso, o anche tra il candidato e altri collaboratori del docente titolare. La prova orale non è superata se il candidato mostra di non aver compreso le nozioni fondamentali e/o non essere in grado di esprimersi in modo chiaro e di usare la terminologia corretta.

Assessment methods

 

Final oral exam. A part of it may take place with a professor's assistant. To pass the final exam a student must demonstrate his/her knowledge of the basic notions taught during the course and to be able to express them in the correct way.
