Gli studenti acquisiranno le conoscenze necessarie a comprendere il funzionamento dell'ordinamento europeo e le sue istituzioni.
In particolare, riguardo alla parte generale, gli studenti approfondiranno le fonti europee (di rango primario e secondario) e le principali procedure interistituzionali. Inoltre, sapranno orientarsi tra le principali competenze della Corte di giustizia dell'Unione europea.
Riguardo alla parte speciale, lo studio sarà dedicato ai profili strutturali e funzionali dell'azione esterna dell'UE, alla politica estera e di sicurezza comune (PESC) e alla politica di sicurezza e difesa comune (PSDC). Ciò consentirà agli studenti di conoscere anche questa peculiare area di interesse dell'UE.
At the end of the course, students will possess the necessary knowledge to understand fully the functioning of the European legal order and that of its Institutions.
Concerning the general part, students will understand in detail the sources of EU law (both primary and secondary sources) and the main procedures involving two or more Institutions. Furthermore, students will also be able to understand the functioning and the competences of the Court of Justice of the European Union.
As far as the special part is concerned, the work will be focused on institutional and functional aspects of the external action of the EU, on the Common Foreign and Security Policy and on the Common Security and Defence Policy. This will allow students to know this specific area of EU interest.
Per verificare l'acquisizione delle conoscenze sarà svolto un test intermedio (on-line) a metà corso.
Qualora l'insegnamento dovesse essere impartito "in presenza", per l’accertamento delle conoscenze potranno essere svolte una o più prove in itinere con modalità da definire.
To check the knowledge acquired, a midterm test will be carried out.
If the course is carried out on campus, to check the knowledge acquired, one or more midterm tests may be carried out.
Al termine del corso, gli studenti saranno in grado di analizzare situazioni reali, applicando le conoscenze apprese. Grazie all’acquisita padronanza degli strumenti giuridici pertinenti, sarà in grado di comprendere i problemi contemporanei che caratterizzano, da un lato, l’ordinamento dell'Unione europea (per la parte generale) e, dall'altro lato, le sue relazioni esterne e, in quest'ultimo caso, in particolar modo il settore della Politica Estera e di Sicurezza Comune (PESC) e la Politica di Sicurezza e Difesa Comune (PSDC).
At the end of the course, students will be able to analyze real situations, applying the knowledge that they have learnt. They will have the necessary instruments to understand contemporary problems that the European legal order faces currently as well as the challenges of the EU in its external relations, with specific respect to CFSP and CSDP.
Gli studenti saranno coinvolti nell'analisi di casi concreti di giurisprudenza, sui quali saranno chiamati a esprimere il loro punto di vista, alla luce delle competenze e delle capacità di analisi acquisite.
Students will be involved in the analysis of national and european case law, on which they will be asked to express their views, in light of the competences and skills acquired.
Lo studente potrà acquisire e/o sviluppare capacità di valutazione con spirito critico in relazione alle problematiche giuridiche trattate.
The student will acquire and develop the necessary skills to examine and critically evaluate the legal problems analysed during the course.
Durante il corso (sia "on-line" sia "in presenza") gli studenti verranno sollecitati a prendere posizione ed a esprimere il proprio punto di vista in relazione alle questioni giuridiche più problematiche che verranno trattate. Potranno essere organizzate attività seminariali, anche su argomenti di attualità, al termine delle quali potrà essere richiesta una breve relazione scritta o orale concernente gli argomenti trattati.
During the course (both on-line and on campus) students will be invited to express their views on the most problematic legal issues examined during lectures.
Seminars, on specific topics, may be organized. At the end of such activities, a short report (in written or oral form) may be asked to students, on the topics covered.
Nessun prerequisito obbligatorio richiesto. Tuttavia, per seguire il corso in modo proficuo, è consigliabile che lo studente abbia una buona conoscenza del funzionamento dell’ordinamento giuridico internazionale ed interno e che lo stesso presti costante attenzione agli avvenimenti politici europei (anche di più stretta attualità).
No specific prerequisite is required.
However, to follow the course with profit, it is recommended to have good knowledge of the international and national legal orders, and to be up to date with most recent events taking place in the european arena.
E' utile possedere alcune nozioni chiave di diritto internazionale e tenersi aggiornati con gli avvenimenti politici e giuridici europei.
It is useful to have a general understanding of international law and to keep up to date with political and legal european developments.
