Al termine del corso:
The student who successfully completes the course will be able to demonstrate an institutional knowledge of the EU legal system, will be able to understand and analyze the case-law of the Court of Justice and critically understand the main process of European Union integration with particular reference to the inter-relations among institutions, the relationship between national and EU legal orders and the main features of the ESDP.
The student will be able to demonstrate an institutional knowledge of International Law of Armed Conflict and
The student will be assessed on his/her demonstrated ability to discuss the main course contents using the appropriate terminology.

After attenting to this course students will be able to conduct research and analysis of sources of EU law and to solve practical EU law cases.
Analisi, commento e presentazione di case studies da parte degli studenti
The student’s ability to apply notions learnt during the course will be assessed in the final exam.
The student will be able to acquire and develop specific sensibility to legal issues taught during the course
During the course, students will be asked to discuss the most problematic aspects of the notions which will be explained. Oral reports about matters explained might be arranged during the course.
Nozioni giuridiche di base
Students must have a good knowledge of the functioning of the international and national legal order. Students are asked to pay attention to current developments in european affairs.

Verte sulle tematiche relative ai principi fondamentali del diritto internazionale umanitario dei conflitti armati. Saranno analizzate le norme di ius in bello relative alla protezione di chi non partecipa o non partecipa più alle ostilità, con riferimento a questioni specifiche come la nozione di partecipazione diretta alle ostilità. Saranno approfondite, inoltre, le norme sulla limitazione dei mezzi e metodi di combattimento, con particolare riferimento alle problematiche giuridiche connesse a nuove tipologie di armi e all'uso dell'intelligenza artificiale. L’interrelazione tra diritto dei conflitti armati e diritto internazionale dei diritti umani sarà oggetto si specifica analisi, con particolare riguardo anche al tema della tutela della popolazione civile nei territori occupati. Una parte del corso sarà dedicata al diritto internazionale penale, con riferimento ai crimini di guerra ed ai correlati profili di responsabilità.

Il C
corso si propone di fornire gli strumenti per una conoscenza approfondita degli aspetti istituzionali del processo di integrazione europea e di delineare un quadro delle tematiche più rilevanti del diritto materiale dell’Unione. La prima parte del corso sarà rivolta all’esame della struttura e del funzionamento dell’Unione europea: in particolare, verranno analizzati i rapporti tra l’ordinamento dell’Unione europea e gli ordinamenti interni, le istituzioni, le fonti, le competenze, le funzioni legislative e non legislative, le competenze della Corte di Giustizia dell’Unione europea. La parte speciale avrà invece ad oggetto la politica estera di sicurezza difesa e la struttura militare dell'UE.
The course, held in English, is divided in the following three modules:
- Law of Armed Conflict (24 hours)
- Common Security and Defence Policy (24 hours)
- Crisis Response Operations/Peace Support Operations (24 hours)
LOAC Module
It will introduce participants to basic principles and sources of International Humanitarian Law of Armed Conflicts from its origin to contemporary armed conflicts. Then it will focus on the questions of applicability, i.e. the scope of applicability of LOAC and the relationship with Human Rights Law. Then attention will be paid to the “Geneva Law” and particularly the rules on the protection of all those not or no more participating in the hostilities. Participants will then learn the specificities of the “Hague Law”, which focuses on the regulation of the means and methods of warfare in order to limit human suffering, taking into account the challenges raised by the development and sophistication of weapons and the use of artiificial intelligence.
A final part will focus on war crimes and International Criminal Law.
CSDP Module
The course aims to provide an in-depth knowledge of institutional aspects of EU integration process and a general picture of the main aspects of selected EU policies. The first part of the course covers the following topics: the evolutions of the European process of integration; division of competences between the European Union and Member States; the functioning of the institutions; the EU sources of law; primacy of EU law; direct effect, responsibility of States, human rights protection. Then it will focus on the Common Security and Defence Policy (CSDP), taking into account its evolution and the development of the European military structures.
CMOs/PSOs Module
This module focuses on the law applicable to different kinds of military operations, bearing in mind the framework in which they are deployed. So the first part will focus on the use of force in international relations. Then attention will be paid to the legal framework related to the military operations deployed in the framework of the United Nations, the European Union and NATO. The students will analyse case studies in order to become familiar with the different norms applicable in each of these different contexts. Specific attention will be paid to the Rules of Engagement (ROE) and gender mainstreaming with reference to 1325 WPS Resolution.
Notes:
The course belongs to an experimental military ERASMUS project and will be attended also by students coming from partner Universities and Military Academies. All the three modules are also recognised by the European Security and Defence College (ESDC).

L’esame si svolgerà in forma orale
Final exam: oral. The oral test consists of an interview between the candidate and the Commission. During the final exam the student shall demonstrate his/her knowledge of the most important notions taught during the course and express them in the correct way.
