Learning outcomes
Knowledge
The student who successfully completes the course will be able to thoroughly understand a constitutional court case on the protection of human rights and to demonstrate a knowledge of the arguments that the italian constitutional court usually takes into consideration in the judicial review of legislation involving human rights. In particular the student will be able to describe the standards of review that the Italian constitutional Court takes into consideration in the solution of cases involving a violation of equal protection as declared in art. 3 of the italian constitution. He will also be aware of the differences and the analogies with the legal arguments used by other courts, such as the italian highest court (Corte di Cassazione) or the European Court of Human Rights (ECHR), or other Supreme/constitutional courts.
Assessment criteria of knowledge
- The student will be assessed on his/her demonstrated ability to discuss the main course contents using the appropriate terminology. - During the oral exam the student must be able to demonstrate his/her knowledge of the course material and be able to discuss the cases discussed during the course. - in the written exam (3 hours, 2 or 3 essay questions) the student should demonstrate his/her knowledge of some of the contents of the course and comment the constitutional articles that have been taken into consideration during the course.

Further information:
Evaluation of the written test at the half of the course will count for a 50%. Oral exam at the end of the court will count for the remaining 50%.

Syllabus
The courts aims at describing the general principles in the protection of fundamental rights in the italian judicial system and in the constitutional court case law. It will focus in particular on articles 2 and 3 of the Italian constitution which declare the principle of the protection of fundamental rights of man and the principle of equality. Particular attention will be paid to application of the equal protection clause in the italian constitutional case law, also in a comparative perspective: many cases concerning gender equality and discriminations on the basis of religion or sexual orientation will be discussed and thoroughly analyzed by the teacher with the students.
Bibliography
Recommended reading include a manual on the protection of human rights in the italian constitution. Italian constitutional case law will be made available to the students by the University of Pisa e-learning platform.
