Al termine del corso lo studente potrà acquisire conoscenze rispetto ai contenuti della materia, concernenti gli aspetti più prettamente pubblicistici della comparazione. In particolare, verranno approfondite alcune delle nozioni fondamentali della materia, quali quelle di «costituzione», di «giustizia costituzionale», di «forma di stato» e di «forma di governo». Tali nozioni, già acquisite nell’ambito dei corsi pubblicistici, saranno oggetto di indagine in chiave comparatistica.
At the end of the course the student will be able to acquire knowledge about the contents of the subject, concerning the purely public law aspects of the comparison. In particular, some of the fundamental notions of the subject will be examined, such as those of "constitution", "constitutional justice", "form of state" and "form of government". These concepts, already acquired in the context of the national public law courses, will be the object of a comparative research.
Le conoscenze si accertano al termine del corso con un esame finale, secondo le modalità indicate nello specifico campo.
Knowledge is checked at the end of the course with a final exam, according to the ways described in the specific field.
Al termine del corso, lo studente sarà in grado di svolgere una ricerca e analisi delle fonti, della dottrina e della giurisprudenza attraverso l’impiego del metodo comparatistico. L’approfondimento, in chiave di «microcomparazione» di taluni istituti di ambito pubblicistico consentirà di acquisire gli strumenti essenziali per orientarsi nello studio delle esperienze straniere, con precipuo riguardo a quelle riconducibili alla tradizione giuridica occidentale.
At the end of the course, the student will be able to carry out researches and analysis of the sources, the scholarship and the case-law through the use of the comparative method. The analysis in depth, through a "micro-comparison" approach of some institutes of public law field will allow acquiring the essential instruments to orient themselves in the study of the foreign experiences, with specific regard to those that are part of the western legal tradition.
In sede di esame finale sarà valutata la capacità applicativa degli studenti delle nozioni apprese durante l’insegnamento.
During the final exam the practical skills of the students will be assessed on the concepts learned during the course.
Lo studente potrà acquisire e/o sviluppare sensibilità alle problematiche giuridiche trattate. L’approccio comparatistico, che verrà tradotto nella concretezza della «microcomparazione», sarà suscettibile di applicazione nelle più diverse questioni giuridiche che lo studente si troverà ad affrontare.
The student can acquire and / or develop sensitivity to the legal issues to which the course deals with. The comparative approach, which will be translated in the concrete terms of the "micro-comparison", will be subject to application in the most different legal issues that the student will face.
Durante i corsi potranno essere organizzate attività seminariali, al termine delle quali verrà richiesta una breve relazione scritta/orale concernente gli argomenti trattati.
During the courses, seminars may be organized, at the end of which a brief written / oral report will be requested concerning the topics analysed.
Per sostenere l’esame, è richiesto il previo superamento di quello di Sistemi giuridici comparati. Gli argomenti trattati durante il corso e nella bibliografia di riferimento richiedono una sufficiente conoscenza delle nozioni di base della scienza comparatistica e del diritto costituzionale, ma anche elementi di storia (moderna e contemporanea) e di filosofia del diritto.
Sono fortemente consigliati la capacità di lettura di un testo in lingua straniera (preferibilmente inglese) e l’aggiornamento con riguardo alle più significative vicende dell’attualità costituzionale dei principali paesi europei e degli Stati Uniti.
In order to pass the exam, it is required the prior overcoming of that of Comparative legal systems. The topics analyzed during the course and in the reference bibliography require a sufficient knowledge of the basic notions of comparative and constitutional law, but also elements of history (modern and contemporary) and of jurisprudence.
The ability to read a text in a foreign language (preferably English) is strongly recommended, as is the updating with regard to the most significant events of the constitutional actuality of the main European countries and the United States.
Il corso avrà ad oggetto l’inquadramento sistematico di una serie di ordinamenti costituzionali e la loro classificazione. Il criterio di riferimento che verrà utilizzato nell’approntare la classificazione sarà rappresentato dalla nozione di «costituzione» ricavabile nei vari sistemi.
The course will focus on the framework of a series of constitutional legal orders and their classification. The criterion of reference that will be used in preparing the classification will be represented by the notion of "constitution" in the various systems.

II, solo Sez. II (pp. 50-87); Cap. III (pp. 89-110); Cap. IV (pp. 111-157); Cap. VII (pp. 283-334); Cap. VIII (pp. 335-377); Cap. IX, solo Sez. I e II (pp. 379-466); Cap. X, solo Sez. I e II (pp. 541-630).
Il volume sarà disponibile in formato integrale oppure in estratto, per le parti sopra indicate.
Agli studenti frequentanti potranno essere consigliati approfondimenti relativi ad argomenti non trattati o sommariamente trattati nei testi, in sostituzione di parti degli stessi.
For the preparation of the exam, it is recommended the study of the volume L. Pegoraro – A. II (pp. 50-87); Chapter III (pp. 89-110); Chapter IV (pp. 111-157); Chapter VII (pp. 283-334); Chapter VIII (pp. 335-377); Chapter IX, only Section I and II (pp. 379-466); Cap. X, only Sec. I and II (pp. 541-630).
The volume will be available in integral format or in extract, for the parts indicated above.
Students attending lessons will be request do analyze in-depth topics not covered or summarily treated in the texts, replacing parts of the same.
Il programma di studio per gli studenti non frequentanti è identico rispetto ai frequentanti per ciò che attiene ai testi consigliati. Le variazioni più significative riguardano alcuni degli argomenti trattati nel corso delle lezioni, che trovano solo parziali riscontri nel libro di testo. Gli studenti, se interessati, potranno avvalersi di ulteriori testi, consultabili sulla piattaforma elearning.
The study program for students non-attending lessons is identical to those attending as far as recommended texts are concerned. The most significant changes regard some of the topics covered during the lessons, which are only partially reflected in the textbook. Students, if interested, will be able to take advantage of further texts, which can be consulted on the e-learning platform.
La prova orale consiste in un colloquio tra il candidato e il docente, o anche tra il candidato e altri collaboratori del docente titolare. La prova orale non è superata se il candidato mostra di non aver compreso le nozioni fondamentali e/o non essere in grado di esprimersi in modo chiaro e di usare la terminologia corretta.
The oral exam consists of an interview between the candidate and the professor, or even between the candidate and other collaborators of the professor. The oral exam is not passed if the candidate shows that he has not understood the basics of the course and / or is unable to express himself clearly and use the correct terminology.
