Syllabus

The course focuses on the peculiarities of mixed jurisdictions, i.e. mixed legal systems that share some similiarities both with common law and civil law systems and on the legal tradition of India (which is, in some respects, a mixed jurisdiction as well). In particular the course will focus on the sources of law, and judicial review of legislation in mixed jurisditions. Among the legal systems that will be analysed during the course I will focus mostly on Quebec and South Africa. In those countries judicial review of legislation has many interesting features, and constitutional court cases provide very interesting insights on the use of different sources of law, comparative law, and the dialogue with different juridisdictions.

The classes will be held as seminars. The teacher will provide some materials (cases, scholarly works, legislation) that will be useful to better understand the topics that have been addressed during the course and that will provide also material for a debate with the students. All th e materials will be made available on the e-learing platform of the University of Pisa.
