Conoscenze

Scopo del corso è quello di esaminare alcuni modelli processuali stranieri, con particolare riferimento a quelli anglosassoni (Inghilterra, USA), per comprendere, paragonare e mutuare le modalità di risoluzione delle controversie civili in culture giuridiche diverse da quella italiana.

Ambito privilegiato di comparazione sarà quello delle tutele collettive: l’analisi del modello principale di azione di classe, negli Stati Uniti d’America, consentirà di meglio interpretare ed applicare il sistema interno italiano dei procedimenti collettivi di cui agli artt. 840-bis e seguenti del codice di procedura civile.

Knowledge

With this approach, the following topics are examined:

  1. Introduction: The context of disputes over family relationships. The family founded on marriage, on convivencies, on civil unions.
  2. The reasons for a differentiated judicial protection in the context of cognition and execution in disputes over family relationships.
  3. The judge, the parties and the lawyer of the minor.
  4. The anticipatory protection.

4.1. The President's provisional measures in separation and divorce.

4.2. Orders to protect against violence in coexistence.

4.3. The precautionary measures in the “rito camerale”.

4.4. The process for the amendment of the conditions of separation and divorce.

  1. The protection in the ordinary process.

5.1. The procedure for separation and divorce.

5.2. The “rito camerale”.

5.3. The residual actions regulated by the ordinary process.

  1. The appeals: The complaint, the special appeal, the extraordinary appeal.
  2. The implementation of the protection.
  3. Lawyer-assisted negotiation
Modalità di verifica delle conoscenze

L'insegnamento si svolgerà con lezioni frontali, condivisione di materiale, discussione di casi.

Le conoscenze acquisite saranno verificate mediante prova orale.

Assessment criteria of knowledge

During the class, in addition to the institutional explanation of the discipline of internal law by the teacher, even with the help of some collaborators, will be held seminars concerning the regulation of some countries of the European Union.

For the ascertainment of knowledge the attending student will have to prepare and exhibit one of the seminarial topics and demonstrate an adequate knowledge of the program treated during the institutional lessons by the teacher, with the help of slides that will be distributed during the class, the notes taken during the lessons and a thorough the study of the manual (see bibliography and teaching material).

For the ascertainment of knowledge, the non-attending student will have to study the book published by the teacher (see bibliography and teaching material).

Capacità

Al termine del corso lo studente avrà acquisito criteri, capacità e metodi di lettura ed analisi delle discipline processuali di altri ordinamenti, al fine di utilizzarli per approfondire, in comparazione, gli strumenti processuali interni italiani di risoluzione delle controversie.

Modalità di verifica delle capacità

Lo sviluppo delle capacità sarà verificato con la prova orale finale ed eventualmente con la realizzazione di elaborati scritti.

There will be an oral exam at the end of the class.

Comportamenti

Oltre alle lezioni frontali, saranno condivisi documenti normativi ed altro materiale, anche disponibile in internet, in particolare sui siti istituzionali dei ministeri e degli organi giudiziari; sarà stimolata la discussione per far emergere profili di interesse per il diritto processuale civile interno italiano.

Behaviors

The student will be able to acquire the abilities described in particular way with the attendance of the course and interacting with the slides, with the group open on facebook and with the participation in the seminars.

Nel corso delle lezioni sarà promossa l'interazione tra studenti e docente, con discussione di casi e con esame di modelli, di atti e di casi.

Non sono previste propedeuticità, ma si consiglia vivamente di aver sostenuto l'esame di diritto processuale civile (o, in alternativa, istituzioni di diritto processuale).

Lo scopo del diritto processuale comparato.

I modelli tradizionali di processo civile. Civil law e common law. Intrecci ed attualità della distinzione.

Cenni alle caratteristiche essenziali e ad istituti particolari dei sistemi francese, tedesco e spagnolo.

Il diritto processuale dei paesi anglosassoni. Storia, formazione ed evoluzione del processo di common law in Inghilterra e Stati Uniti d’America. Il processo civile inglese. Il processo civile negli Stati Uniti d’America.

SECONDA PARTE

Le tutele collettive.

La class action negli Stati Uniti d’America.

Le azioni collettive e di classe nell’Unione Europea.

I procedimenti collettivi in Italia. Gli artt. 840-bis ss. c.p.c.

Modalità d'esame

 

L'esame consisterà in un colloquio orale con il docente e i collaboratori.

 

Assessment methods

For attending students the exam consists of an oral interview with the teacher, which opens with the exposition of a seminar topic treated during the course by the student and continues with the discussion of topics and issues that will be suggested by the teacher and that have been treated during the course itself.

 

For those not attending the exam consists of an oral interview with the teacher on topics and issues dealt with in the manual.

In both cases it will be necessary for the student to demonstrate his ability in presenting his knowledge, with the use of technical terminology and knowledge of the fundamental topics examined during the class or dealt with in the manual.

Additional web pages

There will be a private group on facebook.com (comparative civil procedural law, University of Pisa, academic year ... / ...), to which students will have access with prior permission from the teacher and group administrators, in which there will be posted slides and all the essential material for the study and in which the student can post questions that will be clarified by the teacher and the group administrators, with answers that all members of the group will be able to view. Since a group is open for each academic year, the student will take care to request enrollment in the group of the current academic year.
