Lo studente attraverso gli argomenti trattati acquisirà una sensibilità verso i temi del diritto dell'Unione europea. Ciò permetterà lo sviluppo di conoscenze e strumenti utili nell’orientamento e nell’interpretazione dei casi d’attualità.
Lo studente sarà capace di analizzare e comprendere testi complessi con oggetto i temi trattati nel corso. Sarà in grado di leggere in modo critico le notizie sulla stampa che riguardano l'attività dell'Unione europea e saprà valutare la loro attendibilità;
sarà in grado di valutare la credibilità delle posizioni assunte dai vari Stati membri su temi europei e di identificare la solidità degli stereotipi del populismo con riguardo all'Unione europea.
In particolare, lo studente acquisirà conoscenze in merito alla composizione e al funzionamento delle istituzioni dell'Unione europea, alle fonti del diritto e ai loro effetti, ai rimedi giurisdizionali esperibili dinanzi alla Corte di Giustizia europea e a selezionate questioni di attualità che riguardano il funzionamento dell'Unione europea.
Lo studente saprà altresì distinguere le istituzioni dell'UE da quelle di altre organizzazioni internazionali; saprà identificare i cambiamenti in atto nell'UE; sarà in grado di comprendere gli obblighi che derivano dall'applicazione dei Trattati istitutivi dell'UE per gli Stati membri; sarà in grado comprendere gli effetti giuridici degli atti adottati dalle istituzioni sulla base dei Trattati istitutivi dell'UE; saprà comprendere ed esaminare criticamente il testo di una sentenza della Corte di Giustizia. Lo studente conoscerà quali sono le competenze dell'Unione europea e distinguerle da quelle degli Stati membri.
The student will develop an understanding of the way the EU institutions work and will be able to develop tools to interpret facts and issues related to the EU; s/he will be able to analyse and understand complex texts that deal with topics covered in the course; s/he will be able to critically examine news related to the EU in the press and to assess their reliability; s/he will be able to understand the credibility of Member States' positions on EU-related subject-matters and to make their own judgment on populist ideas about EU.
In particular, the student who successfully completes the course will be able to know the scope of the EU competences, how the EU institutions work, how legislative and non legislative acts are adopted within the EU, the sources of EU law and their effects and the judicial remedies available before the Court of Justice and on selected recent legal issues concerning the functioning of the EU.
The student will be able to distinguish the powers and functions of the different EU institutions and to identify the differences between the EU and other international organizations; to identify changes in the EU; identify the obligations arising from Member States' partecipation to the EU Treaties

The teaching method of the course is based on the student's participation, thus contributing to improve the student's communication and organizational skills.
Il corso è strutturato in modo da garantire degli spazi di confronto utili allo sviluppo di capacità comunicative e argomentative.
The course is structured in such a way as to allow space for discussion, thus fostering the development of communication and argumentative skills. Students will have to read in advance the material made available by the chiar holder for the tutorials on the e-learning platform.
There are no intermediate exams.
Lo studente maturerà una sensibilità verso le problematiche relative al tema dell'UE. Sarà in grado di formarsi opinioni personali e discutere in modo argomentato le sue deduzioni.
Gli studenti devono avere sostenuto l'esame di diritto pubblico.
Students will be able to fully understand the classes after they have taken public law.
Il corso è fortemente raccomandato a studenti interessati a continuare gli studi magistrali (LM 52 e LM 63).
Il course is strongly recommended to students interested in pursuing post graduate studies (LM 52 and LM 62).
Il corso comprende:
1. Lezioni frontali (durante il corso verranno impiegati slide e immagini a sostegno degli argomenti trattati).
2. Discussione di problemi di attualità collegati all'UE.
Il materiale utilizzato dalla docente potrà comprendere documenti redatti in lingua inglese.
The course is based on:
1. Lectures (slides and images will be used to support the lectures).
2. Discussions on current issues of EU law.
Il corso affronta i seguenti temi:
1. Differenza tra l'UE e altre organizzazioni regionali;
2. Caratteristiche di dinamismo dell'UE (con riguardo ai suoi membri (e al suo allargamento) nonché alle sue competenze); l'allargamento
3. Le competenze dell'Unione europea e degli Stati membri;
4. L'apparato istituzionale: il Consiglio, il Consiglio europeo, la Commissione europea, il Parlamento europeo, la Corte di Giustizia; l'Alto rappresentante dell'UE per gli affari esteri e la politica di sicurezza
5. Le procedure decisionali, gli atti dell'Unione e la teoria dell'effetto diretto; la cooperazione rafforzata;
6. Il ricorso di fronte alla Corte di Giustizia.
7. La partecipazione dell'UE in altre organizzazione internazionali
The course covers the following topics:
1. Differences between the EU and other regional international organizations;
2. Dynamic characters of the EU: (with respect to its membership and the extension of its competences); the enlargement
3. EU/Member States competences;
4. the Council, the European Council, the European Commission, the Court of Justice, the High Represenative of the Union;
5. The interinstitutional procedures, EU acts and their effects, including the direct effect; the enhanced cooperation.
6. The remedies before the Court of Justice.
7. The partecipation of the EU in other international organizations
Students attending the course should study:

3. The reading material available on the MOODLE platform.

Erasmus students
Students wishing to take the exam should take an appointment with professor Poli at the following email address: Sara.Poli@unipi.it.
Students may choose to attend the course which is held in Italian or to take the exam in English with the following programme: European Union law, 2014, Oxford University press, edited by C. Bernard and S. Peers. The pages to study are the following: 1-31; 36-70; 98-139; 174-194; 255-292.
This set of pages cover the history of EU, the nature of the organizations, the political institutions, the acts that can be adopted, the decision making process and legal remedies before the Court of Justice.
In addition, the students will have to prepare a presentation on a topic agreed with professor Poli. The presentation will be weighted 1 or 2 points (which are additional with respect to the mark received at the oral exam).
Students attending the course should study:

Gli studenti NON frequentanti dovranno preparare l'esame sul seguente testo:

Gli studenti potranno essere interrogati anche su questioni di attualità legate al processo di integrazione europea.
Students NOT attending the course will prepare the exam on the following text:

Students should be informed on news related to the EU and they may be asked questions on latest developments affecting the EU .
L'esame è orale.
L'esame si basa su una prova orale. Gli studenti frequentanti dovranno partecipare all'80 per cento delle lezioni. La titolare del corso di riserva di verificare la presenza effettiva alle lezioni da parte degli studenti.
The exam is oral.
Students regularly attend the classes if their partecipation rate to the classes is= or higher than 80%.
