Al termine del corso lo studente avrà acquisito le conoscenze in merito all'uso di forme digitali ed elettroniche nell'ambito del processo penale e del processo civile, alla luce delle normative europee e delle recenti riforme interne.
At the end of the course, the student will have acquired the knowledge regarding the use of digital and electronic forms in criminal and civil proceedings, in the light of European regulation and recent domestic reforms.
Onde verificare l'apprendimento da parte dello studente, si farà principalmente riferimento alle relazioni o tesine da svolgersi, durante il corso, su singole tematiche concordate con i docenti, nonché alle esercitazioni condotte nell'ambito delle attività seminariali.
The course will require that the students complete an amount of coursework as a part of their assessment: the latter would include written research working papers and brief dissertations on specific topics as well as the attendance at seminar courses held by different keynote speakers.
Terminato il corso lo studente sarà in grado di muoversi con sicurezza nel novero delle fonti normative di riferimento, comprese quelle di soft law; di individuare le coordinate necessarie per comprendere i mutamenti in atto; nonché di valutarne benefici e criticità.
At the end of the course, the student will be able to move confidently within the range of regulatory sources of reference, including soft law sources; to identify the coordinates needed to understand the changes taking place; and to assess their benefits and criticalities.
Allo studente saranno sottoposte specifiche quaestiones iuris dalla cui risoluzione potrà essere apprezzata la capacità di dare concretezza alle categorie studiate fino a quel momento.
The student will be subjected to specific quaestiones iuris from the resolution of which the ability to give concreteness to the categories studied so far can be appreciated.
Lo studente potrà maturare una particolare sensibilità rispetto alle tematiche concernenti l'incontro tra ICT e giustizia.
The student will be able to develop a particular sensitivity to issues concerning the encounter between ICT and justice.
Gli studenti saranno chiamati a confrontarsi sugli aspetti più controversi relativi alle questioni specificamente trattate nell'ambito del corso e dei seminari e a esaminare criticamente il ventaglio di possibili soluzioni.
The students will be required to have an active attitude during the course also by attending seminars and by partecipating to any debate concerning any single critical issues connected to the lessons topic.
Nell'ottica di una partecipazione più consapevole dello studente alle lezioni, è consigliabile il possesso delle nozioni essenziali di diritto pubblico.
In order for the student to participate more consciously in the lessons, it is advisable to have the essential knowledge of public law.
Le modalità didattiche adottate sono distinte tra studenti frequentanti e non frequentanti.
Con riguardo agli studenti frequentanti, le modalità didattiche constano nelle lezioni frontali e nella sollecitazione di una partecipazione il più possibile attiva da parte dei medesimi (affidamento di tesine, di relazioni, costituzione di piccoli gruppi di ricerca).
Con riguardo, invece, agli studenti non frequentanti, oltre allo studio dei testi consigliati, durante tutto l'anno accademico essi potranno usufruire del sussidio rappresentato dal ricevimento del docente e dei suoi collaboratori, secondo gli orari indicati nelle pagine web del Dipartimento.
The teaching methods adopted distinguish between attending and non-attending students.
With regard to attending students, the teaching methods consist of face-to-face lectures and the encouragement of their active participation as much as possible (assignment of papers, reports, formation of small research groups).
With regard to non-attending students, in addition to studying the recommended texts, throughout the academic year they will be able to make use of the assistance provided by the lecturers and his collaborators, at the times indicated on the Department's web pages.
L'insegnamento avrà ad oggetto le seguenti tematiche:

- Indicazioni dalla “Grande" e dalla “Piccola” Europa;
A) profili processual-penalistici
- Le fonti del PPT;
- La (nuova) forma dell'atto processuale penale;
- Il deposito telematico;
- I fascicoli e i registri informatici;
- Le nuove forme di documentazione delle attività
- Il sistema delle videoconferenze.
B) profili processual-civilistici
- la forma elettronica dell'atto nella teoria dell'invalidità degli atti processuali civili; - il mandato elettronico; - la notifica e comunicazione elettronica; - la formazione elettronica degli atti processuali civili e dei provvedimenti del giudice; - la produzione elettronica di documenti. Cenni alle prove elettroniche; - l'intelligenza artificiale nel processo civile; - le impugnazioni e il giudizio in cassazione.
The course will be devoted to deal with the following subjects:

- Directions from 'Big' and 'Small' Europe;
A) criminal procedural law
- The sources of the PPT;
- The (new) form of the criminal procedural act;
- The presentation of documents;
- The electronic files and registers;

Ferma l'identità del programma di esame sia per gli studenti frequentanti che per gli studenti non frequentanti, questi ultimi dovranno far riferimento al materiale bibliografico specificamente indicato, mentre gli studenti frequentanti potranno altresì avvalersi, ai fini della preparazione della prova d'esame, del materiale tratto dalle lezioni e da quello loro accessibile in modalità e-learning.
Notwithstanding the identity of the examination syllabus for both attending and non-attending students, the latter must refer to the bibliographical material specifically indicated, while attending students may also make use of the material taken from the lectures and that accessible to them in e-learning format for the purposes of preparing for the examination.
L’esame si svolge attraverso una prova orale consistente in un colloquio tra il candidato e i docenti, o anche tra il candidato e altri collaboratori dei docenti titolari. Lo studente dovrà dimostrare la conoscenza delle tematiche affrontate durante il corso. La prova orale non è superata se il candidato non mostra una sufficiente padronanza delle fonti normative di riferimento, dei principi che presiedono la materia e degli istituti trattati. È altresì necessaria la capacità di esprimersi in modo chiaro e tecnicamente corretto.
The examination is conducted by means of an oral test consisting of an interview between the candidate and the lecturers, or also between the candidate and other co-workers of the lecturers. The student must demonstrate knowledge of the topics covered during the course. The oral test is not passed if the candidate does not show sufficient mastery of the normative sources of reference, the principles governing the subject and the institutes dealt with. The ability to express oneself clearly and technically correctly is also required.
Durante il corso attraverso l'intervento di un docente esterno, con la professionalità necessaria nella materia, saranno dedicati due moduli di tre ore ciascuno alla stesura di un atto informatico e alla tecnica della sua trasmissione alla piattaforma della giustizia.
La lezione renderà necessaria la partecipazione attiva dello studente
During the course, through the intervention of an external teacher, with the necessary
professionalism in the subject, two modules of three hours each will be dedicated
to the drafting of an IT document and the technique of its transmission to the platform
of justice. The lesson will require the active participation of the student
