Al termine del corso lo studente dovrà acquisire conoscenze con riferimento ai principali temi del diritto sindacale e delle relazioni industriali. Trattandosi di un corso avanzato, la materia del diritto sindacale sarà affrontata riesaminando i contributi di dottrina più classici e fondativi, sulla base dei quali si è edificato il sistema teorico e applicativo, con un parallelo e costante sguardo ai principali nodi problematici attuali.
In particolare, gli ambiti approfonditi sono i seguenti:
- Il metodo
- Il diritto sindacale fra pubblico e privato
- Il contratto collettivo: problemi costituzionali
- Il contratto collettivo aziendale
- L’inderogabilità fra legge e autonomia collettiva
- La rappresentatività e la categoria
- La libertà sindacale e lo statuto dei lavoratori
- Il diritto di sciopero: fondamento e titolarità
- Partecipazione e democrazia industriale
- Il ruolo delle alte Corti nella formazione del diritto sindacale
At the end of the course the student will acquire knowledge with reference to the main issues of trade union law and industrial relations. Since this is an advanced course, the subject of trade union law will be addressed by re-examining the most classic and foundational contributions to doctrine, on the basis of which the theoretical and application system has been built, with a parallel and constant look at the main current problematic nodes.
In particular, the areas covered are the following:
- The Method
- Trade union law between the public and private sectors
- The collective agreement: constitutional problems
- The company's collective agreement
- The indispensability between law and collective autonomy
- Representativeness and category
- Freedom of association and the workers' statute
- The right to strike: foundation and ownership
- Participation and industrial democracy
- The Role of the High Courts in the Formation of Trade Union Law
La verifica delle conoscenze si accerta al termine del corso con l’esame finale, secondo le modalità indicate nello specifico campo. Specifiche indicazioni per i frequentanti saranno fornite a lezione.
The verification of knowledge is ascertained at the end of the course with the final exam, according to the procedures indicated in the specific field. Specific instructions for attending students will be provided in class.
Il corso intende fornire i necessari strumenti conoscitivi delle dottrine fondative della disciplina ed una opportuna guida metodologica per poterne affrontare gli snodi principali.
Al termine del corso lo studente sarà tendenzialmente in grado di individuare, selezionare e comprendere il contenuto delle principali fonti di sviluppo della materia del diritto sindacale, nel quale la dottrina, la giurisprudenza e la contrattazione collettiva hanno sempre avuto un ruolo speciale (per il tipo sviluppo “extralegislativo” di questo settore dell’ordinamento).
The course aims to provide the necessary cognitive tools of the founding doctrines of the discipline and an appropriate methodological guide to be able to deal with the main junctions.
At the end of the course, the student will be able to identify, select and understand the content of the main sources of development in the field of trade union law, in which doctrine, jurisprudence and collective bargaining have always played a special role (due to the "extra-legislative" development of this sector of the legal system).
In sede di esame finale sarà valutata la capacità applicativa degli studenti rispetto alle nozioni apprese durante l’insegnamento, eventualmente ponendo allo studente quesiti che partono da casi concreti o domandando allo studente dove e come sono state proposte determinate interpretazioni e quale significato hanno nel contesto complessivo.
During the final exam, the students' ability to apply the notions learned during the course will be evaluated, possibly asking the student questions that start from concrete cases or asking the student where and how certain interpretations have been proposed and what meaning they have in the overall context.
Lo studente dovrà acquisire e sviluppare sensibilità alle problematiche giuridiche trattate, comprendendo quali sono i principi fondamentali e come è opportuno muoversi tra le fonti per trovare le regole di cui è necessario fare applicazione.
Inoltre, poiché il diritto sindacale costituisce una esperienza vicina alla vita quotidiana del cittadino, lo studente sarà in grado di comprendere la terminologia tecnica e le caratteristiche dei principali istituti, anche allo scopo di muoversi con agio e consapevolezza nel mondo del lavoro e di comprendere il dibattito pubblico e mediatico inerente alla disciplina delle relazioni industriali.
Fondamentale sarà inoltre la capacità di distinguere gli orientamenti dottrinali contrapposti e gli argomenti spesi per l’una o l’altra posizione.
The student will have to acquire and develop sensitivity to the legal issues dealt with, understanding what the fundamental principles are and how it is appropriate to move between the sources to find the rules that need to be applied.
Furthermore, since trade union law is an experience close to the daily life of the citizen, the student will be able to understand the technical terminology and the characteristics of the main institutes, also in order to move with ease and awareness in the world of work and to understand the public and media debate inherent in the discipline of industrial relations.
The ability to distinguish the opposing doctrinal orientations and the arguments used for one or the other position will also be fundamental.
Gli strumenti per accertare l'acquisizione da parte dello studente degli obiettivi stabiliti sono, nell’ambito della prova orale finale, la formulazione di quesiti che richiedano di saper coniugare la preparazione mnemonica con la capacità di ragionare sulla ratio degli istituti, per dimostrare di averne compreso la logica.
The tools to ascertain the student's acquisition of the established objectives are, in the context of the final oral exam, the formulation of questions that require the ability to combine mnemonic preparation with the ability to reason on the rationale of the institutes, to demonstrate that they understand their logic.
Nonostante non esistano esami il cui superamento sia propedeutico in modo vincolante, è senz’altro auspicabile che lo studente disponga delle conoscenze istituzionali del diritto sindacale e del lavoro.
Although there are no exams that are required to be passed, it is certainly desirable that the student has institutional knowledge of trade union and labour law.

Il programma di studio è costituito dal volume Oronzo Mazzotta (a cura di), Introduzione al diritto sindacale. Letture e riletture, Vol. I, Giappichelli, 2023.
Al candidato non verrà richiesta la conoscenza integrale di tale testo, ma solo una parte: è infatti possibile prepararsi sui capitoli I, II e III (pagine da 2 a 198) o, in alternativa a discrezione dello studente, sui capitoli IV, V e VI (pagine da 199 a 394).
Ulteriori indicazioni saranno fornite a lezione agli studenti frequentanti.

The candidate will not be required to have a full knowledge of this text, but only a part: it is in fact possible to prepare on chapters I, II and III (pages 2 to 198) or, alternatively at the student's discretion, on chapters IV, V and VI (pages 199 to 394).

L’esame si svolge attraverso prova orale. La prova orale consiste in un colloquio tra il candidato e il docente o tra il candidato e altri collaboratori del docente titolare. Ulteriori indicazioni per i frequentanti verranno fornite a lezione
