Il corso affronterà le caratteristiche e l'evoluzione del federalismo e del regionalismo, con particolare attenzione alle giurisdizioni europee e attraverso un metodo comparatistico.
Nel corso delle lezioni saranno affontati in primo luogo alcuni concetti giuridici fondamentali come la nozione di spazio giuridico europeo, i diversi sistemi di governo (Stato unitario, regionale e federale), il decentramento, l'integrazione regionale e la secessione. Si tratterà poi di acuni nuovi concetti giuridici (federalismo etnico, sovranità condivisa, federalismo giudiziario, e costituzionalismo internazionale) per comprendere le tensioni di sovranità e lo scontro tra localismo e globalizzazione che caratterizzano molto esperienze costituzionali.
Gli studenti saranno in grado di gestire questi concetti e saranno introdotti ai principali dibattiti accademici.
Frequentando il corso, potranno altresì comprendere - nella prospettiva degli Stati regionali e federali - la divisione dei poteri tra i diversi livelli di governo e come la forma di stato incida sullo stato sociale, la redistribuzione delle risorse, la governance di sistemi sempre più pluralistici e società divise, la tutela dei diritti fondamentali in una prospettiva multilivello, il sistema delle fonti del diritto (e in particolare la modifica costituzionale e le fonti primarie). Infine, gli studenti saranno introdotti alle dinamiche degli Stati federali e regionali nelle relazioni internazionali (nelle forme di cooperazione, competizione e processi federalizzanti). Sul piano delle soft skills, gli studenti potranno sviluppare autonomia in termini di riconoscimento delle teorie affrontate nel corso e un'utile capacità di applicarle in altri contesti.
The course will address the features and the evolution of federalism and regionalism, focusing in particular on European jurisdictions and through a comparative legal method.
The course will address traditional concepts – the notion of European legal space, the different systems of government (unitary, regional and federal state), decentralization, regional integration and secession – and new legal concepts (ethnic federalism, shared sovereignty, judicial federalism, subnational and international constitutionalism) in order to understand the constant tensions of sovereignty and the clash between localism and globalisation. Students will be able to manage those concepts and will be introduced to the main scholarly debates.
By attending the course, students will also be able to understand - in the perspective of regional and federal states - the doctrine of separation and division of powers and how the system of government affects the welfare state, the redistribution of resources, the governance of increasing pluralistic and divided societies, the protection of fundamental rights in a multilevel perspective, the system of sources of law (and in particular constitutional amendment and statute law). Finally, students will be introduced to the dynamics of federal and regional states in international relations (in the forms of cooperation, competition, and federalising processes). In terms of soft skills, students will be able to develop autonomy in terms of recognising the theories addressed in the course and a useful ability to apply them in other contexts .
Durante il corso e durante la prova finale sarà verificata la conoscenza della materia da parte dello studente, con particolare attenzione alla sua padronanza del quadro teorico di riferimento. Lo studente dovrà dimostrare le proprie conoscenze utilizzando una terminologia apprprivata e dimostrare di aver acquisito una comprensione critica degli argomenti trattati durante il corso.
A tal fine la partecipazione attiva in aula sarà valutata positivamente.
Il docente metterà a disposizione del materiale attraverso la piattaforma E-Learning del Dipartimento di Giurisprudenza. Durante le lezioni veranno analizzati e discussi contributi dottrinali e pronunce per stimolare la discussione sui temi affrontati e esaminarne la loro concreta applicazione. Questi momenti di discussione avranno una notevole importanza didattic, sebbene essi non avranno alcuna influenza valutativa sul voto finale.
Il docente concorderà con gli studenti la possibilità di svolgere prove intermedie e elaborati scritti finali.
During the course and the exam, the student’s knowledge of the subject will be verified, with particular attention to the ability to apply the theoretical framework of reference. The student must demonstrate her/his knowledge using appropriate language, having gained a critical understanding of the topics covered during the course. Therefore, participation in the classroom is recommended and will be positively evaluated.
The professor will make some material available through the E-Learning platform of the Department of Law. Recent cases or scholarly works will be discussed in order to stimulate and verify students' ability to translate theory into practical application. These moments of exchange will have notable didactic importance; in order not to discourage participation, it is emphasized that they will not have any evaluative influence on the final vote.
The teacher will agree with students the possibility to hold mid-term tests and final written papers.
Alla fine del corso gli studenti
• conosceranno i profili teorici relativi al federalismo ed al regionalismo e le analogie e differenze nel modo in cui essi sono declinati nei vari ordinaemnti e nelle organizzazioni regionali studiate (ad es. federalismo, spazio giuridico europeo, decentramento, minoranze, governance istituzionale, ecc.)
• saranno in grado di esprimere le nozioni apprese con sufficiente chiarezza e in modo comprensibile applicandole anche ad contesti differnti
Con riguardo alle cd. soft skills, gli studenti saranno inoltre in grado di sviluppare autonomia in termini di riconoscimento delle teorie affrontate durante il corso e di gestire la terminologia giuridica da utilizzare anche per i successivi percorsi professionali.
At the end of the course, students will
• be aware of the similarities and differences of specific concepts across the countries and the regional organizations studied (e.g. federalism, European legal space, decentralization, minorities, institutional governance, etc)
• express the notions learnt with sufficient clarity and in an understandable manner in an international context.
In terms of soft skills, students will also be able to develop autonomy in terms of recognising the theories addressed during the course and manage the legal terminology to be used also for their subsequent professional paths.
Poichè il corso si propone di fornire la conoscenza dei profili teorici del federalismo e del regionalismo e la looro differente declinazione in diverse esperienze giuridiche, le capacità saranno verificate in primo luogo attraverso la discussione in aula di casi giurisprudenziali e contributi dottrinali. Nella prova finale (sia in forma scritta che in forma orale) i criteri di valutazione saranno: la capacità di comprensione e di esposizione; l’autonomia di giudizio; le abilità argomentative. Ai fini di affinare tali capacità la partecipazione in aula è raccomandata, da interpretare come un’opportunità di apprendimento, tenuto conto che parte del materiale che sarà discusso e la cui conoscenza è necessaria per l'esame sarà in lingua inglese.
Since the course aims at addressing the theoretical foundations of federalism and regionalism and their different application in different jurisdictions, the skills will be verified in the first place through discussion in classroom of legal cases and scholarly works. In the final exam (both in written and oral form) the evaluation criteria will be: the ability to understand and explain; critical approach and argumentative skills. For the purpose of refining these abilities, participation in the classroom is recommended, although this should be interpreted as a learning opportunity, considering that part of the material for the exam will be in English.
Lo studente maturerà un approccio critico rispetto ai temi trattati. A tal fine, sarà incoraggiato, sia durante le lezioni che nell'esame finale, a illustrare le proprie opinioni personali e discutere in modo argomentato le sue deduzioni.
The student will develop an awareness of the problems relating to theme x. To this end, s/he will be able to form personal opinions and discuss her/his deductions in a reasoned way.
L’acquisizione dei comportamenti verrà rilevata durante tutta la durata del corso e nella prova finale. Nello specifico saranno valutati positivamente i seguenti comportamenti: la partecipazione in aula e la proposta di temi di discussione, l'approccio critico, la capacità di applicare le teorie apprese a contesti differenti, il corretto utilizzo del metodo comparatistico.
The acquisition of behaviours will be verified throughout the course and in the final exam. Specifically, the following behaviours will be positively evaluated: participation in the classroom and the proposal of topics for discussion, the critical approach, the ability to apply the theories addressed during the course to different contexts, the proper use of the comparative method.
Considerato l'oggetto e la natura del corso (opzionale) si raccomanda agli studenti di aver sostenuto gli esami di Diritto Costituzionale I e II per la LMG o di diritto costituzionale per il DILPA e l'esame di Sistemi giuridici comparati (per la LMG) o di diritto comparato pubblico (per il DILPA).

Considering the object and nature of the course (optional), students are recommended to have taken the exams of Constitutional Law I and II for the LMG or constitutional law for the DILPA and the exam of Comparative Legal Systems (for the LMG) or public comparative law (for the DILPA).

Il corso si propone di affrontare i presupposti teorici del federalismo e del regionalismo nello spazio giruidico europeo in una prospettiva di diritto comparato.
Le prime settimane di lezione avranno ad oggetto teorie e argomenti di natura generale, come la nozione di spazio giuridico europeo, i diversi sistemi di governo (Stato unitario, regionale e federale), il decentramento, l'integrazione regionale e la secessione. Si tratterà poi di acuni nuovi concetti giuridici (federalismo etnico, sovranità condivisa, federalismo giudiziario, e costituzionalismo internazionale) per comprendere le tensioni di sovranità e lo scontro tra localismo e globalizzazione che caratterizzano molto esperienze costituzionali.
Nelle settimane successive il corso affronterà le singole esperienze di federalsmo e di regionalismo, sulle diverse forme di organizzazione e sulla autonomia costituzionale delle entità subnazionali, la rloo rappresentanza ed il loro ruolo nel federal decision making process, la ripartizione delle competenze legislative, l'esecizion del potere giurisdizionale, la cooperazione tra i diversi livelli di governo, gli strumenti di tutela del federalimo ed il tema del federalismo fiscale. Saranno inoltre affrontati anche attraverso casi giurisprudenziali temi specifici come la secessione, la tutela dei diritti, la politiica estera. Attenzione verrà infine data a temi attualità costituzionale straniera.
The course aims to address the theoretical foundation of federalism and regionalism in the European juridical space from a comparative perspective.
The first weeks of the course will be focused on general theories and topics, such as the notion of European legal space, the different systems of government (unitary, regional and federal state), decentralisation, regional integration and secession. The course will also address some new legal concepts (ethnic federalism, shared sovereignty, judicial federalism, and international constitutionalism) to understand the tensions of sovereignty and the clash between localism and globalization across different constitutional experiences.
In the following weeks, the course will address some individual jurisdictions in order to illustrate topics such as the internal design of the federal / regional States, the constitutional autonomy of subnational entities and their forms of government, the representation of sub-national units in the federal decision making, the division of legislative powers, intergovernmental cooperation, judicial safeguards to federalism and fiscal federalism. Further topics will be secession, the protection of rights, foreign policy and thez will be illustrated through some landmark cases. Finallz, attention will be paid to current foreign constitutional developments.
PEr gli studenti frequentanti la docente metterà a disposizione del materiale didattico (casi giurisprudenziale e scritti dottrinali) su cui, unitamente agli appunti, gli studenti potranno prepararsi per l'esame finale. Il materiale verrà caricato sulla pagina del corso sulla piattaforma di E-Learning de dipartimento di giurisprudenza.
Per questo motivo, come già precisato, la frequenza dellle lezioni è altamente raccomandata.

For attending students, the teacher will provide teaching material (jurisprudential cases and doctrinal writings) on which, together with the notes, the students can prepare for the final exam. The material will be uploaded to the course page on the law department's E-Learning platform.
For this reason, as already stated, class attendance is highly recommended.
Non-attending students can instead prepare by studying both the following texts:
