Il corso si propone di illustrare i cd. sistemi misti tra common law e civil law, avendo riguardo in particolare alle loro peculiarità in relazione alle fonti del diritto ed alla giurisprudenza costituzionale.
The course aims at focusing on mixed legal systems. It will address, in particular, their peculariaties concerning the sources of law and the judicial review of legislation.
Le conoscenze saranno verificate attraverso una prova finale orale. Tuttavia dopo la prima metà del corso gli studenti potranno, a loro scelta, sostenere una prova intermedia.
Knowldge will be assessed through an oral exam. However, students will be able to take an intermediate and optional exam at mid-course.
Al termine del corso gli studenti dovranno dimostrare di aver acquisito un'adeguata conoscenza delle peculiarità dei sistemi misti e la conoscenza della differenze e delle analogie che distinguono tali sistemi dal sistema di civil law, soprattutto per quanto attiene al sistmea delle fonti, alla tutela dei diritti umani e alla giurisprudenza costituzionale.
At the end of the course students should be able to understand differences and analogies between the civil law system and mixed systems, in particular those concerning the sources of law . They will also be able to describe the peculiarities of judicial review of legislation and human rights law in countries of mixed jurisdictions.
L'esame sarà un esame orale che testerà la conoscenza degli argomenti svolti durante il corso e del materiale fornito agli studenti. Gli studenti potranno sostenere un esame scritto, su base volontaria, a metà del corso. Tale prova intermedia verificherà la conoscenza degli orgomenti svolti nella prima parte.
The final exam will be an oral exam. Its purpose will be to verify teh adequate knowledge of the topics which have been addressed during the classes and the materials that will be provided to the students. At mid-course students will have the opportunity to take an intermediate exam in order to test the knowledge of the issues which have been addressed in the first half of the course
Dato il carattere seminariale delle lezioni in cui saranno discussi ed esaminati dei materiali (normativi, giuripsrudenziali o dottrinali) gli studenti saranno stimolati al dialogo ed alla riflessione comune.
As the classes will mostly be seminars in which the seminar materials (cases, scholarly works, legislative materials) will be thorougly discussed, students should engage in a dialogue with the teacher and their colleagues. The teacher will stimulate a debate on the materials.
Agli studenti è consigliato di sostenere l'esame di Sistemi Giuridici Comparati.

Il corso si propone di illustrare le peculiarità dei cd. sistemi misti tra common law e civil law, con particolare riguardo alle fonti del diritto e di approfondire i caratteri della giustizia costituzionale in questi ordinamenti. Tra gli ordinamenti che saranno presi in considerazione nel corso di lezioni vi saranno il Quebec, il Sud Africa, esperienze in cui la giustizia costituizonale presenta profili di grande interesse e le pronunce del giudice costituzionale offrono rilevanti spunti di riflessione, sia per quanto riguarda ai profli sostanziali che per quanto attiene alle tecniche di comparazione, al di dialogo con altre corti, sia infine sul piano delle fonti utilizzate.
Il corso avrà un carattere seminariale e durante le lezioni saranno forniti dalla docente materiali giurisprudenziali, normativi e dottrinali che risulteranno utili non solo per illustrare gli argomenti affrontati ma anche ai fini di una discussione.
Gli studenti potranno reperire i materiali iscrivendosi al corso sulla piattaforma di e-learning.
Gli studenti potranno dunque preparare l'esame sul materiale fornito dalla docente e discusso durante le lezioni.
The course focuses on the peculiarities of mixed jurisdictions, i.e. mixed legal systems that share some similiarities both with common law and civil law systems. In particular the course will focus on the sources of law, and judicial review of legislation in mixed jurisditions. Among the legal systems that will be analysed during the course I can mention Quebec and South Africa. In those countries judicial review of legislation has many interesting features, and constitutional court cases provide very interesting insights on the use of different sources of law, comparative law, and the dialogue with different juridisdictions.
The classes will be held as seminars. The teacher will provide some materials (cases, scholarly works, legislation) that will be useful to better understand the topics that have been addressed during the course and that will provide also material for a debate with the students. All th e materials will be made available on the e-learing platform of the University of Pisa.
Students can study on those materials and on their notes.
Il materiale utile per la studio e la preparazioen dell'esame (articoli di dottrina, sentenze, testi normativi) sarà messo a disposizione dalal docente sulla piattaforma di e-learning dell'Università di Pisa.
The teacher will provide some materials (cases, scholarly works, legislation) which will be useful to understand the topics that have been explained during the classes and for a debate with the students. All the materials will be made available on the e-learing platform of the University of Pisa.
Gli studenti non frequentanti potranno comunque iscriversi al corso e scaricare il materiale dalla piattaforma di e-learning.Data tuttavia l'assenza di un libro di testo ed il carattere seminariale del corso, si consiglia la frequenza delle lezioni.
Students who will not attend the course could retrieve the seminar papers on the e-learning platfrom. However due to the lack a suggested book and to the kind of classes (seminars in which the material will be explained and discussed) I suggest to the students to attend the course.
L'esame finale sarà in forma orale. A metà del corso gli studenti potranno scegleire di sostenere una prova intermedia scritta che testerà le conoscenze degli argomenti svolti nella prima parte delle lezioni
The final exam will be oral. At mid-course students will be able to take a mid-term written exam in order to verify their knowledge of the topic addressed in the first half of the course.
