Al termine del corso lo studente potrà acquisire conoscenze rispetto ai contenuti della materia, consistenti nell’indagine dei diversi sistemi giuridici, della loro classificazione e delle loro interrelazioni.
Durante il corso verranno infatti affrontati i problemi generali della «macrocomparazione», per poi esaminare, in una prospettiva comparatistica, le forme di organizzazione giuridica e le forme di produzione giuridica.
At the end of the course the student can acquire knowledge about the contents of the subject, consisting in the investigation of the different legal systems, their classification and their interrelation.
During the course the general problems of the "macro-comparison" will be addressed, in order to examine, in a comparative perspective, the forms of legal organization and the forms of legal production.
La verifica delle conoscenze si accerta al termine del corso con un esame finale, secondo le modalità indicate nello specifico campo.
Knowledge is checked at the end of the course with a final exam, according to the ways described in the specific field.
Al termine del corso, lo studente sarà in grado di svolgere una ricerca e analisi delle fonti, della dottrina e della giurisprudenza, adottando un approccio caratterizzato dall’uso della comparazione tra ordinamenti diversi, statali e non statali, ed a quella che si sviluppa nell’ambito delle istituzioni dell’Unione europea.
At the end of the course, the student will be able to carry out research and analysis of sources, scholarship and jurisprudence, adopting an approach characterized by the use of the comparison between different systems, national and non-national, and of the comparison that is developed within the institutions of the European Union.
In sede di esame finale sarà valutata la capacità applicativa degli studenti delle nozioni apprese durante l’insegnamento.
During the final exam the practical skills of the students will be assessed on the concepts learned during the course.
Lo studente potrà acquisire e/o sviluppare sensibilità riferite alla comparazione giuridica ed al metodo che la caratterizza, anche attraverso un confronto tra metodo deduttivo e metodo induttivo.
The student will be able to acquire and / or develop sensibility related to legal comparison and to the method that characterizes it, also through a comparison between the deductive method and the inductive method.
Durante i corsi potranno essere organizzate attività seminariali, al termine delle quali verrà richiesta una breve relazione scritta/orale concernente gli argomenti trattati. In tali occasioni, il confronto tra metodo deduttivo e metodo induttivo verrà operato mediante la disamina puntuale di una serie di decisioni fondamentali rese dai tribunali costituzionali e dalle corti supreme dei più importanti ordinamenti contemporanei.
During the courses, seminars may be organized, at the end of which a brief written / oral report will be requested concerning the topics covered. On such occasions, the comparison between the deductive method and the inductive method will be made through a detailed examination of a series of fundamental decisions made by the constitutional courts and by the supreme courts of the most important contemporary systems.
Dato che il corso non ha per oggetto materie diverse da quelle che sono oggetto delle altre discipline giuridiche, ma tende a far comprendere come tali materie – o singoli istituti – possano essere analizzate con metodo comparatistico, è prescritto che l’esame possa essere sostenuto solo dopo il superamento di quelli di Diritto privato I e di Diritto costituzionale I.
Lo studio della comparazione giuridica richiede, in effetti, il possesso delle nozioni di base, acquisite nello studio di esami storici ed istituzionali, di diritto privato e di diritto pubblico. Sono altresì richieste la conoscenza delle principali dottrine gius-filosofiche e la capacità di orientarsi in merito alle più significative vicende della storia contemporanea.
È fortemente consigliata la capacità di leggere testi in lingua inglese.
Since the course does not cover subjects other than those that are covered by other legal courses, but tends to make it clear how these subjects - or individual institutions - can be analyzed with a comparative method, it is prescribed that the exam can be sustained only after passing those of Private Law I and Constitutional Law I.
The study of legal comparison requires, in fact, the knowledge of the basic notions, acquired in the study of historical and institutional courses, of private law and public law. Knowledge of the main philosophical doctrines; the ability to orientate oneself on the most significant events of contemporary history are also required.
The ability to read texts in English is strongly recommended.
Gli argomenti svolti nel corso delle lezioni saranno i seguenti:
. introduzione alla comparazione giuridica (origini, sviluppo, caratteristiche distintive rispetto alle altre discipline giuridiche)
. classificazioni dei sistemi giuridici
. esame delle principali famiglie giuridiche (con particolare riguardo a quelle riconducibili alla tradizione giuridica occidentale)
. l’approccio post-moderno alla comparazione e la convergenza delle esperienze giuridiche
The topics analyzed during the lessons will be the following:
. introduction to legal comparison (origins, development, distinctive characteristics compared to other legal disciplines)
. classifications of legal systems
. analysis of the main legal traditions (with particular reference to those related to the Western legal tradition)
. the post-modern approach to comparison and the convergence of legal experiences
Per la preparazione dell’esame, si consiglia lo studio dei testi che seguono:
– V. VARANO – V. BARSOTTI, La tradizione giuridica occidentale, volume I. Testo e materiali per un confronto civil law common law, VI ed., Torino, Giappichelli 2018, con esclusione delle appendici;
– Dispensa sul diritto islamico reperibile nelle pagine relative al corso inserite sulla piattaforma e-learning del Dipartimento (http://elearning.jus.unipi.it/).
Agli studenti frequentanti potranno essere consigliati approfondimenti relativi ad argomenti non trattati o sommariamente trattati nei testi, in sostituzione di parti degli stessi.
For the preparation of the exam, it is recommended the study of the following texts:
- V. VARANO – V. BARSOTTI, La tradizione giuridica occidentale, volume I. Testo e materiali per un confronto civil law common law, VI ed., Torino, Giappichelli 2018, with the exception of the appendices;
- Paper on Islamic law available on the pages related to the course included on the e-learning platform of the Department (http://elearning.jus.unipi.it/).
Students attending lessons will be request do analyze in-depth topics not covered or summarily treated in the texts, replacing parts of the same.
Il programma di studio per gli studenti non frequentanti è identico rispetto ai frequentanti per ciò che attiene ai testi consigliati. Le variazioni più significative riguardano alcuni degli argomenti trattati nel corso delle lezioni (in particolare, l’approccio post-moderno alla comparazione), che trovano solo parziali riscontri nel libro di testo. Gli studenti, se interessati, potranno avvalersi di ulteriori testi, consultabili sulla piattaforma elearning.
The study program for students non-attending lessons is identical to those attending as far as recommended texts are concerned. The most significant changes regard some of the topics covered during the lessons, which are only partially reflected in the textbook. Students, if interested, will be able to take advantage of further texts, which can be consulted on the e-learning platform.
La prova orale consiste in un colloquio tra il candidato e il docente, o anche tra il candidato e altri collaboratori del docente titolare. La prova orale non è superata se il candidato mostra di non aver compreso le nozioni fondamentali e/o non essere in grado di esprimersi in modo chiaro e di usare la terminologia corretta.
The oral exam consists of an interview between the candidate and the professor, or even between the candidate and other collaborators of the professor. The oral exam is not passed if the candidate shows that he has not understood the basics of the course and / or is unable to express himself clearly and use the correct terminology.
