Il corso si propone di far acquisire allo studente consapevolezza delle questioni più rilevanti della teoria e della pratica dell'interpretazione e dell'argomentazione giuridica.
The course aims to give the student the mastery of the most relevant issues of the theory and practice of legal interpretation and argumentation.
La verifica delle conoscenze avverrà al termine del corso con un esame finale, secondo le modalità indicate più avanti.
The assessment of knowledge will take place at the end of the course with a final exam, according to the methods indicated below.
Alla fine del corso lo studente sarà capace di avvalersi, impiegandoli criticamente, dei concetti e degli strumenti fondamentali del ragionamento giuridico.
At the end of the course the student will be able to use, critically employing, the fundamental concepts and instruments of legal reasoning.
Nel corso dell’esame verrà valutata la capacità dello studente di riconoscere e analizzare criticamente i concetti e gli strumenti fondamentali del ragionamento giuridico.
During the examination the student's ability to recognize and critically analyze the fundamental concepts and instruments of legal reasoning will be evaluated.
Il corso intende fare acquisire agli studenti attitudine a prendere posizione in modo argomentato e coerente sulle questioni in esso affrontate.
The course aims to make students acquiring the aptitude to take position in a reasoned and coherent way on the issues addressed.
Durante il colloquio d’esame, attraverso domande appositamente congegnate, lo studente che avrà proficuamente seguito le lezioni dimostrerà la sua capacità di avvicinarsi allo studio dei temi dell'interpretazione e dell'argomentazione giuridica con sguardo critico e con piena consapevolezza delle dimensioni etiche e politiche ad essi sottese.
During the exam interview, through specially designed questions, the student who will have proficiently followed the lessons will demonstrate his ability to approach the study of legal reasoning with a critical view and with full awareness of the ethical and political dimensions it underlies.
Il corso presuppone un’adeguata conoscenza delle principali tematiche della filosofia del diritto, al pari dei concetti elaborati dalla scienza giuridica nei vari ambiti del diritto positivo.
The course requires an adequate knowledge of the main issues of the philosophy of law, as well as concepts developed by legal science in the various areas of positive law.
Ulteriori modalità di apprendimento e attività di approfondimento potranno essere definite e concordate nel corso delle lezioni.
Further learning methods and in-depth activities can be defined and agreed during the lessons.
Una prima parte del corso sarà dedicata all'approfondimento della teoria del linguaggio nella sua interconnessione con la teoria del diritto e con la tematica dell'interpretazione e argomentazione giuridica.
Nella seconda parte del corso verranno analizzate e discusse criticamente alcune teorie dell'interpretazione giuridica formulate nel corso del Novecento.
Un ciclo di lezioni seminariali sarà dedicato altresì all'analisi di temi e problemi della deontologia delle professioni giuridiche in una prospettiva di genere.
Nel corso delle lezioni saranno indicati e resi disponibili testi e materiali su cui gli studenti frequentanti potranno esercitarsi in vista dell'esame finale.
A first parte of the course will be dedicated to the indepth study of the theory of language in its interconnection with the theory of law and with the topic of legal interpretation and argumentation.
The second part of the course will focus on the critical analysis and discussion of some theories of law and interpretation formulated in the second half of the last century.
Finally, a series of lectures will be dedicated to the analysis of some issues of deontology of legal professions from a gender perspective.
During the lectures, texts and materials on which attending students will be indicated
and made available in view of the final exam.
Gli studenti che frequenteranno il corso potranno preparare l'esame avvalendosi degli appunti presi a lezione e del materiale didattico che sarà messo a loro disposizione tramite la piattaforma e-learning (https://elearning.jus.unipi.it).
In the first instance, students who regularly attend classes are advised to prepare the exam by studying the notes taken in class and the teaching material that will be made available via the e-learning platform (https://elearning.jus.unipi.it).
