L'ADE si pone l'obiettivo di offrire strumenti idonei a comprendere le dinamiche del diritto all'autodeterminazione in sanità secondo una prospettiva giuridica che tenga conto delle ricadute in ambito medico.
La questione centrale sarà quella del diritto all'autodeterminazione nel fine vita alla luce dei casi, delle decisioni, delle ipotesi di regolamentazione e del dibattito che, appunto, vede confrontarsi giuristi e medici. Alle studentesse e agli studenti saranno forniti strumenti per la comprensione di ambiti e problemi che nascono giuridici ma investono il ruolo e le funzioni del medico.
ADE aims to provide tools to understand the dynamics of the right to self-determination in healthcare according to a legal perspective that takes into account the medical implications.
The central issue will be that of the right to self-determination in the end of life in the light of cases, decisions, regulatory hypotheses and debate that, in fact, sees lawyers and doctors confront each other. Students will be provided with tools for understanding areas and problems that arise legally but affect the role and functions of the doctor.
La verifica delle conoscenze avverrà soprattutto attraverso l'analisi di casi concreti nei quali si potrà analizzare la portata del diritto all'autodeterminazione e il suo grado di tutela.
The verification of knowledge will take place mainly through the analysis of concrete cases in which the scope of the right to self-determination and its degree of protection can be analyzed.
Questi i temi che saranno trattati:
- I diritti costituzionali quale fondamento del diritto all'autodeterminazione in sanità: il diritto alla salute, il diritto alla libertà personale, il diritto al consenso informato, la dignità umana.
- Analisi dei casi pratici e il ruolo dei giudici comuni: i casi Welby ed Englaro. Il caso Cappato/Antoniani.
- Il ruolo della Corte costituzionale: l'ordinanza 207/2018 e la sentenza 242/2019 sul caso Cappato/Antoniani
- Gli effetti della sentenza: la modifica del codice di deontologia medica, le ipotesi di legge, i casi successivi più discussi (caso Trentini, caso Carboni etc).
- Le questioni aperte: il rapporto con la l. 219/2017 l'obiezione di coscienza del medico, il caso del paziente oncologico.
The following topics will be covered:
- Constitutional rights as the basis of the right to self-determination in health: the right to health, the right to personal freedom, the right to informed consent, human dignity.
- Analysis of practical cases and the role of the joint judges: the Welby and Englaro cases. The Cappato/Antoniani case.
- The role of the Constitutional Court: Order 207/2018 and Judgment 242/2019 in the Cappato/Antoniani case
- The effects of the judgment: the amendment of the Code of Medical Ethics, the legal hypotheses, the most discussed subsequent cases (Trentini case, Carboni case, etc.).
- The open questions: the relationship with l. 219/2017 the conscientious objection of the doctor, the case of the cancer patient.
Il materiale bibliografico e didattico consisterà in dispense e sentenze che il docente metterà a disposizione di tutte e di tutti nel canale TEAMS dell'ADE LA TUTELA DEL DIRITTO ALL'AUTODETERMINAZIONE IN SANITÀ
The bibliographical and didactic material will consist of handouts and sentences that the teacher will make available to all in the TEAMS channel of ADE THE PROTECTION OF THE RIGHT TO SELF-DETERMINATION IN HEALTH
L'esame consisterà nell'analisi e nella discussione di un caso pratico relativo al tema dell'ADE eventualmente anche nell'ambito di piccoli gruppi.
The examination will consist in the analysis and discussion of a practical case relating to the theme of ADE possibly also within small groups.
